Police said one of the men had appeared on "Empire", and Smollett's attorneys said one of the men is the actor's personal trainer, whom he hired to help get him physically ready for a music video. His bail hearing is expected to be scheduled for 1:30pm on Thursday, according to prosecutors.

Meanwhile, Cook County officials are charging the actor with felony disorderly conduct for his apparent filing of a false police report regarding a hate crime attack he allegedly staged against himself. "A lot more. And that says a lot about the place that we are in our country".

After a long investigation into the alleged incident, Chicago police officially classified Smollett as a suspect Wednesday night for filing a false police report.

Earlier Guglielmi indicated Smollett had been named a suspect in a criminal investigation for filing a fake police report, and that criminal charges had been approved by the Cook County State Attorney's Office (SAO).

Smollett's attorneys released the following statement regarding the charges: "Like any other citizen, Mr. Smollett enjoys the presumption of innocence, particularly when there has been an investigation like this one where information, both true and false, has been repeatedly leaked". They also said they intend to conduct a thorough investigation and mount an aggressive defense.

Several politicians initially spoke out in support of Smollett but have since adjusted their stances, including Democratic Sens.

CBS reporter Charlie De Mar said in a tweet that he had succeeded in tracking down surveillance footage of the Osundario brothers buying supplies ahead of the "attack'".

Doubts about Smollett's account started with reports that he had not fully cooperated with police.

As new details emerged in the case, police have said they want to conduct a follow-up interview with the actor following "some developments". "You don't need immunity when you have the truth", she said. The police spokesman said the brothers appeared before the panel to "lock in their testimony".

A Fox spokesperson had no comment when reached by CNN on Wednesday. Don't forget that the Federal Bureau of Investigation has reportedly begun looking at the threatening letter that got sent to Empire's production studios. Authorities determined the powder to be aspirin, according to Guglielmi. The letters "MAGA" were written in the upper-left corner of the envelope.

Smollett told ABC News the drawing was of a "stick figure hanging from a tree which had a gun pointing towards it".
