A federal judge has suspended an undocumented Ecuadorean man's deportation after he was detained and reported to immigration officials earlier this month while delivering pizza to a military base in New York City.

Villavicencio, who worked at Nonna Delia's pizzeria, an hour away by auto in Queens, produced a city identification card, but the official told him he wanted to see a state driver's license, Chica said.

In an interview Sunday, Copeland told CNN that Villavicencio had been to the military base "many times" in the past to make similar deliveries. A background check showed that Villavicencio had been ordered to leave the United States in 2010, but stayed.

Chica said Luciana was especially crushed on Friday when she "heard a noise outside where the garbage is, and she got so happy". "He was not committing any crime".

Nathan, whom Obama appointed in 2001, had a long history of working with Obama and other Democratic candidates before being appointed as a federal judge. "I knew he was coming!' And I had to tell her, 'Maybe it was a cat that moved the trash can.' And she was so sad", Chica said.

In a letter to the ICE office in New York, New York Gov. Andrew Cuomo said Villavicencio's "expedited removal serves no legitimate public safety goal and the circumstances leading to his arrest and detention raise serious legal and policy concerns".

Cuomo, a Democrat, also told her that a state-provided attorney has talked with Villavicencio, who is being held at a New Jersey facility.

Cuomo said on Thursday that he spoke by phone with Chica to express his "deep frustration with the federal government's assault on New York's immigrant families". "They're going to separate my daughters from him".

Cuomo had helped Villavicencio's family obtain free legal aid Friday in an effort to keep the deliveryman from being deported. "Please don't stop him, don't take him away from us", said Chica.

She and Villavicencio have two daughters, who are 3 and 2 years old and were born in the U.S. Both politicians said they were seeking answers from Fort Hamilton. Brannan asked, according to NPR's Joel Rose.

"ICE may feel confident in its legal position, but our client's confidence in the judiciary, as well as the will of the American people, is stronger", said Jennifer Williams, an attorney with the Legal Aid Society, which is representing Villavicencio.

"As such, his voluntary departure order became a final order of removal", she said.

A spokesperson for Fort Hamilton said that when Villavicencio couln't produce a Department of Defense- issued identification card, he was instructed to secure a day pass.
