Judge Aaron Persky Recalled Over Brock Turner Rape Sentence

Persky sentenced Turner to six months in jail in 2016 for the sexual assault of an intoxicated, unconscious woman outside a campus frat party.

The recall campaign cast Persky as the face of rape culture and his recall as an indictment on a society that normalizes or diminishes violence against women.

Persky's 2016 decision sparked the recall movement, which said Turner's case was just one of many lenient sentences given out by the judge. He is no longer eligible for USA Swimming membership, and he will have to register as a sex offender for life (though he recently appealed his conviction with the hope of overturning that requirement). She believes Persky "abused his discretion and screwed up dramatically", imposing an unjust punishment on Turner and adding insult to injury for the victim, known as Emily Doe.

Many complained Mr Persky showed too much deference to Mr Turner, a white Stanford scholarship athlete whose parents could afford a private attorney.

Two women ran in a separate election to replace Persky in the event of his successful recall, with Cindy Seeley Hendrickson - who Dauber's campaign endorsed - emerging victorious.

According to the California Constitution, a recall can be called whenever voters wish "to express their dissatisfaction with their elected representatives". Recalling a judge is not easy, a reality reflected by its rarity in the electoral process. "I was terrified of it, I didn't know what had been in it, if it had been contaminated, who had touched it", she said. Persky has said he was following the rule of law, not the rule of public opinion, and says he has no regrets. Persky said he was unaware of complaints. But the successful recall of Judge Aaron Persky Tuesday for that controversial sentence could have a chilling effect on other judges who make hard decisions.

Persky, himself a former lacrosse player at Stanford in Palo Alto, California, said at a news conference last month that sentencing guidelines and probation department recommendations had limited his options in sentencing the former student. No matter that Turner will be legally regarded as a sexual offender for the rest of his life, and not only have to frequently report to the local sheriff wherever he lives, but also have restrictions on where he can live.

Persky cited numerous letters of support that friends, former teachers and employers wrote on behalf of Turner.

The election to decide on Persky's removal was held after a petition on the matter gathered enough signatures. KABC's sister station KGO-TV requested access for comment as the results came in, but no commitment were given. An early count - with two-thirds of the county's precincts reporting - indicated that 59 per cent of voters in Santa Clara were in favour. The registrar is expected to certify the results on July 5, spokesman Steven Spivak said.

It was unclear Wednesday what the judge's next career move will be.
